On September 11, the Hong Kong Special Administrative Region (HKSAR) court delivered the sentencing decisions in accordance with the law for the defendants in the case concerning the Hong Kong Alliance in Support of Patriotic Democratic Movements of China (the “Alliance”) and its members LEE Cheuk-yan, HO Chun-yan and CHOW Hang-tung for crimes of “Incitement to subversion”. The Office of the Commissioner of the Ministry of Foreign Affairs in HKSAR firmly supports the sentencing decision made by the HKSAR court in accordance with the law. Following the sentence, certain politicians of few countries and organizations made unwarranted comments, smearing Hong Kong's rule of law and freedom. In response, the spokesperson of the Commissioner’s Office voiced strong dissatisfaction, firm opposition and stern condemnation.
The spokesperson pointed out that the Alliance and the defendants have long engaged in anti-China and Hong Kong-destabilizing activities, inciting the public to overthrow the leadership of the Communist Party of China and undermine the fundamental system of the country and refused to desist even after the implementation of the Hong Kong National Security Law. Their crimes pose a severe challenge to the constitutional order of the HKSAR jointly established by the Constitution of China and the Basic Law,constitute egregious violations of the Hong Kong National Security Law, and gravely undermine the fundamental interests of the country and Hong Kong. They must be held accountable in accordance with the law.
The spokesperson emphasized that Hong Kong is a society governed by the rule of law. The law enforcement, prosecution, and judicial organs of the HKSAR strictly perform their duties in accordance with the law, with procedures that are open, transparent, fair, and just. The litigation rights of defendants are safeguarded by law, and independent adjudication is free from any interference. The criminal facts of the defendants in the case are clear, and the evidence is conclusive and irrefutable. The HKSAR court, in accordance with the severity of their criminal acts, delivered fair sentences in accordance with the law, upholding the authority of the law and safeguarding national security. This is reasonable, justified, and lawful, and brooks no interference.
The spokesperson reiterated that the Central Government firmly supports the HKSAR in safeguarding national security and holding to account acts endangering national security in accordance with the law. We solemnly warn relevant parties to face reality, genuinely respect China's sovereignty and the rule of law in Hong Kong, immediately stop making irresponsible remarks regarding the judicial proceedings of the cases, and cease any form of interference in Hong Kong's judiciary and China's internal affairs. We will resolutely defend our national sovereignty, security, and development interests, and firmly thwart any external interference.
